Terms of Service

1. Acceptance of Terms

By accessing and using the Hope Reads website and services (read.hopenlc.org), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our Service. These terms apply to all users, including learners, parents/guardians, teachers, and administrators.

2. Description of Service

Hope Reads is an educational literacy platform that provides:

  • Guided phonics instruction and practice activities
  • Interactive readers and reading comprehension exercises
  • Educational games and learning activities
  • Progress tracking and learning analytics
  • Customizable profiles and avatars
  • Premium content and features via paid subscriptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts and Registration

To use certain features of Hope Reads, you must create an account. When creating an account, you agree to:

  • Provide accurate, complete, and current information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access
  • Use your account only for lawful purposes and in compliance with these terms

Parents and guardians are responsible for supervision and ensuring children's safe use of the Service.

4. Subscriptions and Billing

4.1 Subscription Plans

Hope Reads offers the following subscription tiers:

  • Free Plan: Limited access to core features
  • Individual Plan: $9.99/month for one learner account with premium features
  • Group Plan: $7.99/user per month (minimum 5 seats) for educational organizations
  • Enterprise Plan: Custom pricing for large-scale implementations

4.2 Billing and Payment

  • Subscriptions renew automatically on a monthly basis
  • Payment is processed through Stripe and charged to the payment method provided
  • You authorize us to charge your payment method for all subscription charges
  • Billing cycles begin on the date of purchase and renew on the same date each month
  • Prices may change with 30 days' notice; continued use constitutes acceptance

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation becomes effective at the end of your current billing cycle. No refunds are provided for partial months, but you retain access until the end of the billing period.

4.4 Group Subscriptions

  • Group plans require a minimum of 5 seats
  • The account holder (typically the school administrator) is responsible for all charges
  • Seat licenses can be assigned to learners via access codes
  • Access codes may be rotated for security purposes

5. Intellectual Property Rights

5.1 Hope Reads Content

All content, including text, graphics, logos, images, audio, video, and software, are the property of Hope Technologies Sacramento Inc or its licensors. You may not reproduce, distribute, modify, or transmit any content without our prior written consent.

5.2 User Content

You retain ownership of content you create and upload (such as Story Writer projects). By uploading content, you grant Hope Reads a non-exclusive, royalty-free license to use, store, and process your content to provide the Service. You represent and warrant that you own or have the necessary rights to the content you submit.

5.3 Limited License

We grant you a limited, non-exclusive, revocable license to access and use Hope Reads for your personal, non-commercial educational purposes, subject to these terms. This license does not permit you to redistribute, reproduce, or create derivative works.

6. Acceptable Use Policy

You agree not to use Hope Reads for:

  • Illegal activities or violation of any laws or regulations
  • Harassment, threats, or abusive behavior toward other users
  • Distribution of malware, viruses, or harmful code
  • Unauthorized access to or interference with the Service
  • Collection of personal data from other users without consent
  • Commercial use or resale of access to the Service
  • Attempted circumvention of security measures
  • Any activity that disrupts the normal functioning of the Service

We reserve the right to suspend or terminate accounts that violate this policy.

7. Limitations of Liability and Disclaimers

7.1 “As Is” Service

Hope Reads is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

7.2 Limitation of Damages

To the maximum extent permitted by law, Hope Technologies Sacramento Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

7.3 Educational Purpose Disclaimer

Hope Reads is designed as a supplementary educational tool. It is not intended to replace professional educational or medical advice. Teachers and parents are responsible for assessing the appropriateness of the Service for individual learners.

8. Data and Security

  • We implement industry-standard security measures to protect your data
  • You are responsible for maintaining the security of your account credentials
  • We are not responsible for unauthorized access due to your negligence
  • Learning data is automatically stored and synced across your authorized devices
  • We retain aggregate, de-identified collective reading-time totals and cumulative user counts for nonprofit impact and grant reporting, including after individual account deletion
  • Your data is retained according to our Privacy Policy

9. Third-Party Links and Services

Hope Reads may contain links to third-party websites and services that are not operated by us. We are not responsible for the content, policies, or practices of third-party sites. Your use of third-party services is governed by their own terms and conditions.

10. Children and Guardian Responsibilities

  • Hope Reads is designed for children and young learners
  • Parents and guardians are responsible for appropriate supervision and use
  • We comply with applicable children's privacy laws, including COPPA
  • Parents/guardians can request access to or deletion of a child's account and data
  • We do not knowingly collect information from children under 13 without parental consent

11. Indemnification

You agree to indemnify and hold harmless Hope Technologies Sacramento Inc, its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

12. Modifications to Terms

We may update these Terms of Service at any time. Material changes will be notified via email or posting on this page. Your continued use of the Service following such notifications constitutes your acceptance of the updated terms.

13. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. You agree to submit to the jurisdiction of the state and federal courts located in Sacramento County, California.
